Suspect claims victim "came onto him" | Crime
Investigators say a man charged with sexual assault told them the victim "came onto him."
Christopher Cunningham, 31, of Tuckerman is charged with Second Degree Sexual Assault, a Class B felony.
According to court records, on December 20 sheriff’s deputies were called to a home in Independence County just before 3 a.m. regarding the possible sexual assault of a minor.
When officers arrived they reportedly found Cunningham in a F-150 pickup truck parked in the driveway. When he stepped out of the truck, deputies noted his pants were unzipped.
In the affidavit, Cunningham reportedly told deputies the victim “came onto him” and he was “just a man.”
During the investigation, deputies reported finding evidence “that shows Mr. Cunningham did force himself on her as evidenced by bite marks on her body, as well as scratches and bruising.”
The court records also indicate that Cunningham admitted during an interview with investigators that “he had rubbed his hands across her bare buttocks and other parts of her body and had been kissing her.”
Cunningham is being held at the Independence County Jail in lieu of $10,000 bond.
